Amigomio...there's no call for the animosity, flaming, name calling, etc. in your post. What set you off? Do you feel threatened when a Gringo is knowledgeable about Mexican law?

For the record:

I speak Spanish. I have a FM3 Visa, Mexican DL, and for many years I've maintained a home in Tijuana. (Some years it's been my secondary residence and other years my only residence.)

I have spoken to more than one Mexican attorney practicing law in Tijuana. (One is a former federal prosecutor.) They all tell me, "prostitution is legal in Tijuana." They are the ones who tell me there is a difference between prostitution and actives related to prostitution (such as solicitation) that I posted about above.

Furthermore, as I stated above, it is state and local laws--not Mexican Federal Law--that governs prostitution. So what happens in other cities isn't really applicable to TJ.

If you don't believe me about prostitution being legal in Tijuana then do what I did: Shell out some money and speak to an attorney who practices criminal law in TJ.

In Mexico the Mexican Minister of Health has classified Viagra, etc. as a Category IV medication. That means a Rx is required to purchase it, but the pharmacy does not have to maintain a record of who purchased it (unlike Category I-III medications). The practical result is that a man can purchase ED medication in TJ w/o a Rx. That's also why the TJ police have "shaken down" tourists for carrying these medications w/o a Rx.

The reason behind Category IV rules is that historically many Mexicans have been too poor to consult a physician when ill. (Even in these days of Seguros Social and Popular the law fills a need.) Many poor turn to pharmacists for medical advice--so Mexican law "winks" at having a Rx for non habituating medication.

Back to business: That phrase is so vauge, like the word ACTIVITES encompasses everything related to prostitution, not just strutting around.

It gives so much freedom to the judge to decide what not to do or do that you would be surprised.

Why do you think you can be picked up for carrying Cialis or Viagra? Cause it is related precisly with this "reglamento". If you are carrying Viagra or Cialis without a prescription, you are doing activies related to drugs and the judge can see it this way and fined for having them in your posession.

You still don't understand that in our simplicity, Mexican law if aplied (not allowing for corruption) is easy to understand and interpret.

You'll never get it cause you Americans want it spelled out to you in plain English, crossing the "Ts" and dotting the "Is".

By the way, only the small cities like TJ have Zonas.
The big ones like Monterrey, Guadalajara, Tampico, Veracruz... do not have them.

So if they see a hooker in the streets, she is picked up on the spot.
And I mean on the streets as in the sense that if in the big cities, if a club girl leaves the club and crosses the street to buy something at a 7-11, she can be picked up.

Streetwalkers are picked up on the street (unless the cops are on the take or paid protection by the girls).

And so on and so on.

Mine took about 4 weeks.

The CBP are not fining people for crossing without a passport or passcard. You won't have any problems crossing with just a driver's license. Having a copy of your birth certificate and passport/passcard with you will probably save you a lecture of needing to apply for a passport/passcard.

My estimate is that 1/3 the people crossing don't have a passport or passcard.

The actual act of prostitution is legal, but public manifestation of prostitution is illegal. For example, it is illegal for a chica to stand on the sidewalk soliciting customers. But the law is not enforced within the Zone of Tolerance. In like manner a monger cannot solicit a chica in public outside the Zone of Tolerance. These are acts related to prostitution.

Here’s the big picture: Little old ladies, young girls, etc. are not supposed to be exposed to prostitution. Hence activities related to prostitution are illegal in public (outside a Zone of Tolerance). But prostitution is legal—if not done publicly.


I want to see the written Mexican law that states breathing is legal. My point? The law does not enumerate legal activities—only illegal activities.

Also, the laws governing prostitution are local and state laws—not Mexican federal law. So what is legal and illegal varies from city to city and state to state. (My comments are only intended to apply to Tijuana.)

There's no abscence of law, it's right there.

And let's get this clear: maybe in the US you can do whatever you want without breaking the written law (which in many cases it's not true), but there are parts in the world, many to speak the truth, that require a specific law to make it legal and if it is not in the Book, you can not do it.

It's written proof from the Municipio de Tijuana's Reglamento del Bando de Policيa.

Sometime ago someone said that a Mexican lawyer friend of his said that prostitution was legal in Mexico and this poster was never able to produce the law.

I want to see the written Mexican Law that states that prostitution is legal in Mexico, which many of you quote and we have never seen.

Little Man, am sorry to tell you but prostitution is not legal in Mexico.

It is tolerated, that's why la Zona is called that way, cause it's la Zona de Tolerancia.

But not legal in the sense that it is in the law books as "prostitution is legal in Mexico".

The passing of laws if to be done, is by the corresponding state, in this case Baja California, but they in place have left the Municipio de Tijuana to pass ordenances if it is accepted or not.

It is only seen as a misdemeanor, and fineable from 450 up to 1,230 peso in Tijuana, and can you can be held accountable for many things right now in the Federal level (specially human traffiking) if the authorities would like to do it, but no, cause it's tolerated.

Thankfully we have TJ. US is illegal, and MX is Legal. For a tourist you want to go where it's legal and go back home safely. In TJ, you get to see through your own eyes not pictures.

With your proclivity towards large I don't figure they will be ones you know though. I like'em tiny. Two of the ones I've been watching are Asian. Never had Asian before might just give it a go. Then if the Pass Card is in I figure to head down to TJ for some quantity mongering.
